Our Services may include links to third-party websites, plug-ins, and applications that we do not own or operate. We are not responsible for the practices employed by any websites or services linked to or from the Services, including the information or content contained within them. ABOUT OUR BUSINESS MODEL

You may be using any of our Services on your own, after finding us on the internet or based on a friend's recommendation, or you may be using the Services as requested by your employer, lender, or other company with whom you have a relationship. In the course of providing our Services, you or your employer, lender, or other company may provide or upload business or personal documents (all of which we call "Client Data") to our Services, which may include personal information or data about you, a company's end users, or other individuals (please note that the contents of these documents may include personal information which is not described in this Policy). COLLECTION AND USE OF SENSITIVE PERSONAL INFORMATION

Collection And Use Of Biometric Information. With your consent, we may use data collection and verification services provided by third-party providers, including Jumio and Persona, to verify identity and biometric information in order to comply with our legal obligations and protect against fraud and abuse. Jumio and Persona may use a combination of human review, and machine-learning tools and optical scans to verify your identity document and may use facial recognition technology to produce a unique biometric identifier based on facial geometry that can be used to compare your selfie to the image on the identity document you provide to determine the likelihood that the images are a "match." We do not receive the biometric identifier generated from the images; that identifier is generated and held by Jumio or Persona (as applicable) for verification purposes until we inform them that the biometric identifier is no longer needed (generally 30 days). For identity verification and security purposes, we will have access to the selfie image and will receive the information extracted from the scan of the government ID document as well as the results of the verification process. We may use this process and associated information to verify your identity and your identity documents, comply with legal obligations and protect against fraud and abuse. We do not use, disclose, or retain your biometric information for any other commercial purpose. Our third-party providers, including Jumio and Persona, process this information on our behalf strictly in accordance with our contractual agreements.

DISCLOSURE OF PERSONAL INFORMATION

In order to fulfill the legitimate business purposes for which we collected your personal information, we may disclose your personal information with:

We also may disclose personal information to other parties in connection with a corporate business transaction or potential transaction in the event that NotaryCam merges with another organization, files for bankruptcy, or sells some or all its assets or capital stock. DE-IDENTIFIED (ANONYMIZED) AND AGGREGATE DATA

NotaryCam may de-identify (as also referred to as "anonymize") and aggregate data for its business purposes, including but not limited to, to improve the products and features of its Services, to maintain the security and integrity of its systems, for analytics, and other legitimate business purposes. "De-identified Data" means information that cannot reasonably be used to infer information about or otherwise be linked to a particular data subject. De-identified Data includes anonymized data and is no longer "personal information" under applicable data protection laws. Where we process De-identified Data, we commit to maintain and use the information in de-identified form and not attempt to reidentify the information, except where permitted by law. NotaryCam may disclose De-identified Data to third parties who commit themselves to maintaining the De-identified Data in anonymized form and not attempt to re-identify the data for any business purpose.

About Cookies

"Cookies" are small files which enable us to store individual information related to your computer or other device used to access our website. Cookies help us, e.g., to determine the frequency of use and the number of people visiting our website and to create our services as comfortable and efficient as possible for you.

Classes of Cookies. There are two types of cookies: session cookies, and persistent cookies.

Sources of Cookies. Cookies also come from different sources – NotaryCam (these would be "first-party cookies" because NotaryCam places the cookies itself), and other third parties (these are "third-party cookies" because they are not placed by NotaryCam).

Third-Party Cookies and Website Analytics. We use third-party services including Google Analytics to analyze website activity. When you visit the websites, Google Analytics automatically collects information from you through the use of Google's analytics IDs, and Google provides some of this information to us. An analytics ID is a specific string of numbers and letters (often called a "character string") that is assigned to your computer or device but does not name you. The analytics ID allows Google to track usage data of the websites, such as date and time of visit, duration of visit, website traffic patterns, "clickstreams," other similar information about your use of the websites, the type of web browser used, the operating system/platform you are using, your IP address, the websites that referred or linked you to our website, and your CPU speed. DATA RETENTION

We will usually store the personal information we collect about you for as long as necessary to fulfil the purposes for which it was collected, and in accordance with our legitimate business interests and applicable law. However, if necessary, we may retain personal information for longer periods of time, until set retention periods and deadlines expire, for instance where we are required to do so in accordance with legal, tax and accounting requirements set by a legislature, regulator, or other government authority.

To determine the appropriate duration of the retention of personal information, we consider the amount, nature and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of personal information and if we can attain our objectives by other means, as well as our legal, regulatory, tax, accounting, and other applicable obligations.

When an individual discontinues the use of our services, we will retain their personal information for as long as necessary to comply with our legal obligations, to resolve disputes and defend claims, as well as, for any additional purpose based on the choices they have made, such as to receive marketing communications. In particular, we will retain personal information supplied when joining our services, including complaints, claims and any other personal information supplied during the duration of an individual's contract with us for the services until the statutory limitation periods have expired, when this is necessary for the establishment, exercise, or defense of legal claims.

In all cases, in addition to the purposes and legal bases, we consider the amount, nature and sensitivity of the personal information, as well as the potential risk of harm from unauthorized use or disclosure of your personal information.

Once retention of personal information is no longer necessary for the purposes outlined above, we will either delete or deidentify the personal information or, if this is not possible (for example, because personal information has been stored in backup archives), then we will securely store the personal information and isolate it from further processing until deletion or deidentification is possible.

YOUR PRIVACY RIGHTS

Right to Access and to Know — You have the right to access the personal information collected about you. You also may request to know the categories of personal information collected about you, the information or categories of information shared with third parties, or the specific third parties or categories of third parties to which the information was shared; or some combination of similar information. However, there are certain exemptions, meaning that data subjects may not always receive all of the information we process.

Right of Complaint — If you believe that the processing of your personal information violates applicable laws and regulations, please contact us at privacy@NotaryCam.com. We will always try to find a solution together. Should this not be possible, you have the right to complain to a Data Protection Authority about our processing of your personal information. Right to Correct — Without prejudice to your right to review or change the information in your account to make sure it is accurate and up-to-date, you also have the right to request rectification of any other of your personal information which has been provided to us if you consider it to be inaccurate or incomplete.

Right to Data Portability — Under certain circumstances, you may request us to transfer your personal information, provided by you, to another controller. Also, you have the right to receive your personal information, which has been provided by you, in a structured, commonly used and machine-readable format and to transmit those data to another controller.

Right to Delete / Erasure — You generally have a right to request your personal information or part of it to be erased (e.g., when your personal information are no longer necessary for the stated purposes in this Policy, the personal information have been unlawfully processed); however, we may not always erase your personal information because sometimes the processing is still necessary. For example, for complying with statutory obligations or for lodging, exercising or substantiating legal claims. Therefore, we will weigh your interest in having your personal information erased against the necessity of maintaining the personal information for our legitimate interests. Please be aware that if you request us to delete your personal information, you may also not be able to continue to use the Platform.

Right to Restriction — Under certain circumstances, you may have the right to restrict a business's ability to process personal information about you; for example, if the accuracy of your personal information is contested, the processing is unlawful, or personal information is no longer needed for purposes of the processing. However, we can still use restricted data in certain circumstances (e.g., when your personal information is needed for legal claims or to protect another data subject's rights).

Right to Notification of Correction, Deletion or Restriction — Unless it is impossible or involves a disproportionate effort, we will inform the recipients of your personal information about correction, deletion or restriction of processing.

Right Against Automated Decision Making/ Profiling — You may have the right to not be subject to a decision based solely on an automated process without human input.

Right of Objection — Under certain circumstances, you may object to the processing of your personal information by us or third parties engaged by us. We will consider several factors when assessing an objection to our processing in furtherance of our legitimate interests, including: our users' reasonable expectations; the benefits and risks to you, us, other users, or third parties; and other available means to achieve the same purpose that may be less invasive and do not require disproportional effort. Your objection will be upheld, and we will cease processing your information, unless the processing is based on compelling legitimate grounds or is needed for legal reasons. For example, you may object to the use of your personal information for direct marketing purposes.

Right to Withdraw Consent — If we have requested your explicit consent for data processing, you have the right to withdraw your consent at any time. The withdrawal of consent will not affect the lawfulness of the processing prior to the withdrawal.

Right to Opt In for Sensitive Data Processing — Under certain circumstances, you may have the right to opt in (or consent) before we can process your sensitive data.

Right to Opt Out of Sale, Share, Profiling, and Targeted Advertising — Where applicable, in the U.S., you may opt out of the Sale or Sharing of personal information to third parties, as those terms are defined by U.S. federal, state and local laws. You may exercise this right by clicking on the "Your Privacy Choices" link located at the bottom of our homepage or by submitting a request as described in the How to Submit a Request to Exercise Your Rights section below.

How to Submit a Request to Exercise Your Rights. To submit a request to exercise one of the privacy rights identified above, please submit a request by emailing us at privacy@NotaryCam.com. To opt-out of the sale or sharing of your personal information, please use the privacy preferences center by clicking on the cookie icon in the bottom left-hand corner of our webpage.

What We May Need from You. We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal information (or to exercise any of your other rights). This is a security measure to ensure that personal information is not disclosed to someone who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

Verifying Your Identity. To protect your privacy and security, we may need to verify your identity before processing your request, which may require us to request additional personal information from you or require you to log into your account, if you have one. We will only use personal information provided in connection with a Consumer Rights Request to review and comply with the request.

In certain circumstances, we may decline a request to exercise the rights described above, particularly where we are unable to verify your identity or locate your information in our systems. If we are unable to comply with all or a portion of your request, we will explain the reasons for declining to comply with the request.

Submitting Authorized Agent Requests

In certain circumstances, you are permitted to use an authorized agent to submit requests on your behalf through the designated methods set forth in this Policy. If you designate an authorized agent to make a request on your behalf, we may require you to verify your identity and provide the authorized agent's identity and contact information to us.

For requests to know, delete, or correct personal information, we require sufficient evidence to show that you have:

  1. provided the authorized agent signed permission to act on your behalf (such as a valid power of attorney under the laws of the jurisdiction where you reside); and
  2. verified your own identity directly with us pursuant to the instructions set forth in this Policy; or directly confirmed with us that you provided the authorized agent permission to submit the request on your behalf.

For requests to opt-out of personal information "sales" or "sharing", we require a signed permission demonstrating your authorized agent has been authorized by you to act on your behalf.

Responses to Requests. We will respond to your request as soon as possible, and no later than one month from receipt of your request. In doing so, we will also assess whether, and if so to what extent, we can or must comply with your request under the applicable laws. If a longer period of time is needed, we will inform you within one month of receipt of the request. The submission and processing of your request is free of charge, unless your request is manifestly unfounded or excessive, in particular because of a repetitive character.

Appealing Privacy Rights Decisions

Depending on your state of residency, or the country where you reside, you may be able to appeal a decision we have made in connection with your privacy rights request. All appeal requests should be submitted at privacy@NotaryCam.com.

CHILDREN'S PERSONAL INFORMATION

Our Services are not directed to, and we do not intend to, or knowingly, collect or solicit personal information from children under the age of 18. If an individual is under the age of 18, they should not use our Services or otherwise provide us with any personal information either directly or by other means. If a child under the age of 16 has provided personal information to us, we encourage the child's parent or guardian to contact us to request that we remove the personal information from our systems. If we learn that any personal information we have collected has been provided by a child under the age of 18, we will promptly delete that personal information.

CHANGES TO THIS POLICY

We reserve the right to change this Privacy Policy from time to time at our sole discretion. We will notify you about material changes in the way we treat personal information by sending a notice to the primary email address specified in your NotaryCam account and/or by placing a prominent notice on our website. It is your responsibility to review this Privacy Policy periodically. When we do change the Privacy Policy, we will also revise the "last modified" date.

ADDITIONAL DISCLOSURES

International Data Transfers

When you use our Services, your personal information will be collected by NotaryCam and stored in the United States of America where we operate and are headquartered. Additionally, we may use third-party vendors which transfer, store, or process personal information in a country other than the one in which it was collected. We will only engage processors who adequately implement appropriate technical and organizational measures and who guarantee the protection of your rights. In order to ensure this, we enter into data processing agreements with our processors. This is compulsory under the data protection laws. The data processing agreement regulates, among other things, data security, confidentiality and your rights.

If your personal information is transferred to 'third countries' – i.e., countries outside the European Economic Area ("EEA") – we will only do so if the third country offers an adequate level of protection. In some countries outside the EEA – which as at the date of the last update of this Policy include Andorra, Argentina, Canada (commercial organizations), Faroe Islands, Guernsey, Israel, Isle of Man, Japan, Jersey, New Zealand, Republic of Korea, Switzerland, the United Kingdom under the GDPR and Directive (EU) 2016/680, the United States (commercial organizations participating in the EU-US Data Privacy Framework) and Uruguay (for more information and up to date list of the countries please, check here) – your personal information are sufficiently protected in accordance with European data protection laws and regulations. Where this is not the case, we provide appropriate safeguards to ensure adequate data protection, such is the most recent standard contractual clauses as approved by the European Commission and by additional safeguards, a copy of which can be obtained by sending an e-mail to privacy@NotaryCam.com. If no appropriate safeguards are in place, we will only transfer your personal information if a legal exception applies. An example of a legal exception is explicit consent.
